Commentary
· Paper roads - how do they exist?
- What are the rights?
- How do you check if they are on your land?
- Who is liable when the road deviates off a survey?
· Will the legislation be imposed on the Chathams? · Will it be different?
· Are values being taken away?
- Holistic meaning in the Chathams?
- The `undistributed possession' exists.
- Stood up for this principle?
· Need for partnership on the issue, work with the Crown, will talk to the Minister on this.
- Government is now prepared to listen to the people and deal with local government in a more proactive manner.
· Need to look at the issue of foreign ownership.
- What about impact on land sales?
- What would locals do if a foreign owner did not let them onto their land?
- Do not sell the land.
- Money will change it.
· Cannot always get access to DOC estate, have to ask in some areas.
- At Henga Reserve, DOC fenced off a road that had been used for many, many decades, it has failed in its role.
· The asking for access means that we cannot get access that is too loose.
· What about OSH?
· How would traditional access be identified, protected and categorised?
· This could be too rigid as new purposes come up in the future, it is dangerous to be prescriptive.
· The traditional ways have worked.
· Do not formalise an informal relationship with legislation.
· Address the issue by telling tourist at their accommodation houses how to behave in the outdoors.
· How much support of the `status quo' has there been around the country?
· There is not a problem in the Chathams at the moment, but this could change.
- Sizeable chunks of land are for sale and new owners could restrict access to islanders.
· The status quo cannot be realistic.- The world will not stand still.
· If the landowner has to do the work, who pays?
· Who owns the beds of lakes - problem with Crown owning a large lake when a person has customary uses?
