Commentary

· What about commercial capture, i.e. parts of the river `sold' to professional fishing guides.

-  Have you thought of addressing Fish and Game's right to close waterways?

· If you create a Queen's Chain along the river and give a right of access, will commercial capture no longer exist?

· Is the Queen's Chain on all rivers?

· A private river is a private river, they have a right to close/control access.

· In the UK there are rights of way at most points, some form of public path is very important.

· Clarification of riparian rights, land is still held by owners with rights to the centre of the river.

· Is there going to be a lot of consultation with user groups and landowners to come to a general consensus and agreement?

· How do you feel personally - is this an impasse that cannot be met?

· We seem to have heard a lot of problems.

-  One problem is that rivers and lakes never stay in the same place.

-  There is a solution that if a landowner has a right of access, that negotiated access along the river could be made with a one-off compensation payment - the new price would reflect the fact that there is the covenant on the property.

-  Could use GPS, that allows the access to move with the water.

-  Could state on title, covenant access.

· Are you endorsing exclusive capture through land tenure?

· Under the impression that the Queen's Chain will not be on Maori land.

· 96% of Maori land is owned to the middle of the river.

· Would like to know where navigable and non-navigable rivers fit into this?

· Need to ensure that private roads are not put on maps.

· Where do people get information relating to paper roads and the Queen's Chain?

· The Hastings District Council does not want to know about the access question.

· Will toilets, running water and rubbish bins now have to be provided?

· Trespass Act - served on someone when they landed above the high tide mark.

· There are a lot of Acts out there mentioning access, are they going to be put together into a more relevant, easy to understand Act?

· What is the consultation process from here on?

· Is there a timeframe for when the report will be made public?

· Can people re-send the same submission?

· Access requirements are specific in certain areas, in the Hawkes Bay people are well-equipped for access.

-  Access could be provided through subdivision under the RMA.

-  Each region could develop its own recreational plan.

-  The RMA cannot be used effectively if the district council has no access strategy or plan.

-  Need this to make better use of existing tools.

· We need information on where access stands now, i.e. maps on regions, available access.

· Would like to compliment the Group, but concerned that users will assume that there is a Queen's Chain, meaning free access.

-  Worried that with the publicity, there may be people now blocking access to waterways.

-  Fishers would love to have the Queen's Chain on all rivers.

· If a fisher denies access to water, what does this mean in terms of the Treaty of Waitangi?

· Has there been any discussion on state forests restricting access to park/mountain land?

· Surely government-owned land can open up walkways for access (Crown Forestry Rental Agreements) or will Landcorp properties be opened up?

· Takes section 60 out of the Health and Safety Act, (or clarify it), it is ambiguous and difficult to understand.

-  Farmers are ignorant in terms of access requirements and what their obligations are.

-  A person went to OSH and was told that he had to put signs up on electric fences.

· It appears that it is going to cost the Government a lot of money - perhaps there could be a trade-off with carbon credits?

· The idea of access is admirable, but there is potential for conflict if access is opened up - between guns, gundogs - this conflict needs to be looked at.

· What could be in a code of conduct?

· Who owns the fish?

· Can I kayak/raft to get to the river?

· Capture of exclusive fishing rights.
